Screen Name and Passwords
You hereby agree that You are responsible for all actions taken under Your Screen Name and Password. Please remember it is Your responsibility to keep this data secure and You hereby agree that We are not liable for any loss or damage arising from Your failure to keep Your password secure. Further, You agree to immediately notify Us of any unauthorized use of Your password or any breach of security.
Purchase Policy

Sales Tax
Any and all sales or use tax will be Your responsibility. Sales tax calculations on the web site are an estimate only. Your true sales tax, if applicable, will be calculated and presented to You at the time of product delivery.
Shopping Cart
We maintain a PCI compliant shopping cart. The Payment Card Industry Data Security Standard (PCI DSS) is a set of requirements designed to ensure that all companies that process, store or transmit credit card information maintain a secure environment.
When You make purchases from Us using Your major credit card, You agree to honor the terms and conditions of Your cardholder agreement.
Return Policy
Refunds will be handled according to Our store's policies. Please contact servicesbeacon@gmail.com for a copy of Our store's policies.
FILTER MAINTENANCE
Customers are responsible for regular filter maintenance. Beacon recommends all filters to be changed every 30 days, however some situations may require more frequent filter changing depending on factors such as the number or pets and the local environment. Diagnostic service calls with failures that originate from a lack of proper filter maintenance may not be covered under labor or workmanship warranty.
HVAC DIAGNOSTICS
Beacon’s residential diagnostic service is warrantied for 14 days. During the 14 day period, diagnostic fees are waived on the same piece of equipment. Parts and labor fees may apply to repairs made during the 14 day period. Most HVAC parts installed that are outside of manufacturers warranty carry a 1 year parts warranty and a 90 day labor warranty from Beacon. Systems that are covered under a manufacturers warranty are subject to warranty fees that are charged by the manufacturers distribution companies for the processing of the warranties.
HVAC INSTALLATIONS
Proposals are valid for 30 days only, and are subject to product availability. All proposals include labor, materials, taxes, and all required permitting required by the governing agency in your area. Customers are required to provide availability for the municipality inspection within 90 days of the installation. Total payment is due the day of installation of the equipment. Beacon Air & Heat, Inc retains ownership of all equipment until it has been paid for in full.
APPLIANCE RETURNS
Product returns must be made within 5 business days of the date you receive your order. Returns must be in like new condition. There may not be any marks, scuffs, stains, dents, or scratches.
Beacon reserves the right to decline an exchange or accept the return of ANY product after the 5 business day period. After this period, any issues with the product should be addressed directly with the manufacturer.
Any products that were purchased new and have been used even once no longer may be resold as a new product and are considered used. In many cases, being installed and used, then returned will void the manufacturer’s warranty for a future owner of the product. For this reason, Beacon cannot accept returns due to buyer’s remorse, product failure, or other reasons. The liability for warranty lies solely with the manufacturer.
Previously installed, used, special orders, or special modifications cannot be returned under any circumstance. All accessories, clean instruction books and warranty cards must be returned. Product that does not meet the criteria above or has been used, may, at Beacon’s discretion, not be accepted as a return, or may be subject to additional return and shipping/delivery fees and in some cases significant restocking charges may apply to a restocking fee in an amount representative of the condition of the product or its packaging.
Refunds for products being returned will be issued once the product is received back at and meet Beacon's product return criteria listed above.
There is an expense to this return process and the last thing we want is for a customer to have a bad experience. If through no fault of Beacon a product is returned, we will charge up to a 30% restock (of sales price) fee.
Delivery and installation fees are non-refundable.
There is a $75 removal fee to pick up any appliance(s) regardless if they were delivered by Beacon or customer pick up products. There will be extra labor charges if any appliances need to be uninstalled.
USED APPLIANCES
We do not accept returns of used appliances. All sales are final. Most used appliances do come with a 15 - 90 day parts and labor warranty. If warranty service is required, depending on the issue, Beacon reserves the right to replace the appliance with another of equal value. Warranty service can only be provided within Beacon's service area. Appliances outside of Beacon's service area must be brought to Beacon's location for warranty service.
NEW PARTS
New appliance parts purchased are with their manufacturer's warranties of 30, 60, 90, or 365 day, depending on the manufacturer and type of part. Please ask a Beacon representative about the part you are purchasing for specific warranty information.
ORDERED PARTS
Beacon Services does not offer warranties on any parts that were not installed by Beacon Services, also we do not accept any returns on any parts that were not originally diagnosed by our technicians. Payment is due at the time the part is ordered. It is Beacon Policy not to install any parts that we did not diagnose. Beacon wants you to be happy with your purchase and will make every effort to make sure you are satisfied with your purchase from point of sale, to delivery of the part ordered. The buyer is responsible for making sure this is the part they needed. Beacon is not part of the diagnosis process and cannot be liable for the purchase of an incorrect part, or if additional parts are needed beyond the purchase of a part.
APPLIANCE REMOVAL OR HAUL AWAY
Beacon Services & Appliances reserves the right to refuse to remove or haul away any appliance at any time. Reasons include but are not limited to unsafe conditions, or the condition of the appliance. Appliances with insects or mold infestations will be refused. Appliances that are not the one being immediately replaced may be refused. Appliances that have been left outside will be refused. Beacon Services & Appliances offers free delivery and haul away services for most top load washing machines, top load dryers, and ranges, however we reserve the right to charge for removal and haul away of any appliance based on the labor involved. Appliances that require more than one technician to remove may also have an added fee.
SPECIAL ORDERS
You understand that order dates are not guaranteed and may be subject to delays by the manufacturer, for which Beacon cannot be held responsible. If you cancel an ordered appliance (any appliance not currently in stock at our location) after it has been ordered from the manufacturer, a 6% cancellation fee on the invoice total will apply. In the event that the appliance has already been delivered to our address and you choose to cancel, an additional 10% restocking fee will be applied.
DELIVERY AND INSTALLATION FEES
Delivery is free to most addresses in Beacon’s service area. There are fees for the installation of most appliances after they have been delivered. There may be fees to disassemble the appliance to gain entry into the home, as well as fees for lifting appliances up stairs.
APPLIANCE SIMPLE DELIVERY
Free delivery is a simple drop off of your unopened appliance outside your front door or directly inside a garage door. Door removal to gain access into the home, lifting up stairs, or appliance installation may incur additional fees.
NON-RESPONSIBILITY FOR APPLIANCE TRANSPORTATION AND INSTALLATION
When customers pick up appliances from our store, we are not liable for any damage during transportation, installation, or securing. Customers are responsible for safe transport, proper installation, and securing of their load with proper restraints. Customers picking up appliances from our store acknowledge: 1. Understanding of these terms. 2. Full responsibility for any securing or post-departure damage. 3. Release of Beacon Services and Appliances from liability. 4. Returned appliances must be in new condition as they were provided during pick up.
APPLIANCE DELIVERY AND INSTALLATION TERMS AND CONDITIONS
DELIVERY SCHEDULING:
Deliveries will be scheduled based on the customer’s preferred date and time, subject to availability. The customer will be notified in advance if any changes to the delivery time are necessary.
DELIVERY ADDRESS:
The customer must provide the correct and complete delivery address. Any changes to the delivery address must be communicated at least 24 hours before the scheduled delivery time.
DELIVERY ACCESS:
The customer is responsible for ensuring that the delivery location is accessible and that pathways are clear for the delivery team to move the appliance safely. This includes removing obstacles such as furniture or fragile items.
APPLIANCE INSPECTION:
Upon delivery, the technicians and customer must inspect the appliance for any visible damage. If any damage is found, it must be reported immediately to the delivery personnel and noted on the delivery document.
INSTALLATION SERVICES:
Installation services, if requested, will be performed by qualified technicians. The customer is responsible for ensuring that the installation area meets the necessary requirements, such as electrical outlets, water connections, and ventilation. Installation does not include modifications to existing plumbing, electrical, or cabinetry unless specifically stated in the service agreement.
CUSTOMER PRESENCE:
The customer or an authorized representative must be present at the time of delivery and installation to provide access, inspect the appliance, and sign the delivery and installation confirmation. If the customer cannot be present, the technicians will take multiple photos to document the delivery.
UNFORESEEN CIRCUMSTANCES:
The company is not liable for delays or inability to deliver and install the appliance due to unforeseen circumstances, including but not limited to inclement weather, natural disasters, or restricted access to the delivery site.
WARRANTY AND RETURNS:
The appliance is covered by the manufacturer's warranty, and any issues related to defects or malfunctions must be addressed according to the warranty terms. Returns or exchanges are subject to the company’s return policy. Appliances must be in new, unused condition to qualify for a return or exchange.
LIABILITY:
The company is not responsible for any damage to the customer’s property that occurs during delivery or installation, except in cases of negligence by the delivery personnel. The customer is responsible for securing any permits or approvals required for installation.
PAYMENT:
Payment for the appliance and any associated delivery and installation fees must be made in full before or at the time of delivery unless otherwise agreed upon in writing.
CANCELLATIONS AND RESCHEDULING:
Cancellations or rescheduling requests must be made at least 24 hours before the scheduled delivery time. Failure to do so may result in a cancellation fee.
ACKNOWLEDGMENT:
By accepting delivery and installation services, the customer acknowledges and agrees to these terms and conditions.
Rebates
We provide You every opportunity to save on Your purchase. We offer rebates directly from the manufacturers and from Our buying groups. Most rebates and coupon offers are subject to their own terms and conditions as specified by the rebate sponsor and processor. Product or Pricing Inaccuracies
While we take every precaution to insure all products and pricing are correct on Our web site, mistakes do occur. Should You find a mistake please contact Us at servicesbeacon@gmail.com. Prices and the availability of products and Our services are subject to change without notice. Despite Our best efforts, we will, from time to time, make pricing mistakes. We will endeavor to promptly correct any mistakes as we become aware of them. We reserve the right to revoke any offer and/or correct any error at any time, including after an order has been submitted and even in the event that Your method of payment has been charged. Any disputes related to pricing will be resolved at Our sole and complete discretion.
Preventative Maintenance Agreements
Effective July 1st, 2018
Beacon Services & Appliances / Beacon Air & Heat Inc. only offers one Preventative Maintenance Program Option. This is for new customers as well as renewals of existing Maintenance Contracts. All renewals will renew under the new maintenance agreement effective July 1st, 2018. The old agreements are no longer available, and there will be no "grandfathering" of the previous agreements. We apologize for any inconvienance this may cause.
Beacon's Preventative Maintenance Program Includes:
- Priority attention when you need it the most!
- (2) Clean and Tune maintenance services (At approximately 6 month intervals)
- 20% Discount on all service calls and diagnostics
- 20% Discount on all labor fees
- 20% Discount on all parts and air conditioning related items such as filters or IAQ
- 5% Discount on equipment replacement
This service agreement is for one full year from the initial date of contract. The two maintenances may occur at any time during the year, although we strive for 6 month intervals. PMP customers are notified at the end of the contract however renewals are the responsibility of the customer and contracts do not auto-renew. Filter maintenance is not included and should be performed by the homeowner as needed, as well as drain line maintenance in tandem with this maintenance contract. The contract covers one air conditioning system at a time, though multi-system discounts are available. Discounts do not cross over to other services provided by Beacon such as duct cleaning, insulation, or appliance repair. Preventative Maintenance Agreements are currently only available for our residential Citrus County customers.

TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABLITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT MAKE ANY WARRANTY THAT OUR SERVICE WILL MEET YOUR REQUIREMENTS, OR THAT ANY SERVICE OFFERED BY US WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE, OR THAT DEFECTS, IF ANY, WILL BE CORRECTED; NOR DO WE MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF ANY SERVICE OFFERED BY US OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH ANY SERVICE OFFERED BY US. YOU UNDERSTAND AND AGREE THAT ANY MATERIAL AND/OR DATA DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF ANY SERVICE OFFERED BY US IS AT YOUR OWN DISCRETION AND RISK, AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL AND/OR DATA. YOU ALSO AGREE THAT WE SHALL NOT BE RESPONSIBLE OR LIABLE TO YOU, OR TO ANYONE, FOR THE STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON OR ARISING FROM USE OF ANY SERVICE OFFERED BY US. Indemnification
You hereby warrant that You will not use the information provided by Us in violation of any State or Federal law. Further, You agree to indemnify, defend, and hold Us harmless, as well as holding harmless Our parents, subsidiaries, affiliates, officers, directors, employees, agents, and suppliers, and their respective affiliates, officers, directors, employees, and agents, from any claim, action, demand, or damage, including reasonable attorney's fees, made by any third party or governmental agency arising out of or related to Your use of any service offered by Us or Your violation of this Agreement, including without limitation, claims or suits for libel, violation of rights of privacy or publicity, interference with property rights, trespass, violations of Federal or State Law, patent infringement or plagiarism. We may, at Our sole discretion, assume the exclusive defense and control of any matter subject to indemnification by You. The assumption of such defense or control by Us, however, shall not excuse any of Your indemnity obligations.
Force Majeure
Neither party shall be liable for delays or nonperformance of this Agreement caused by strike, fire or accidents, nor shall either party be liable for delay or nonperformance caused by lack of availability of materials, fuel or utilities or for any other cause beyond its control.
Assignment
You may not assign Your rights or obligations under this Agreement without Our prior written consent.
Intended For Users that are Residents of North America and are Over 18
Our services are available and may only be used by, individuals who are residents of North America and who are 18 years and older who can form legally binding contracts under applicable law. You represent and warrant that You are at least 18 years old, that you reside in North America, and that all registration information You submit is accurate and truthful. You agree to comply with all local laws regarding online conduct and acceptable content.
Disputes
In the event of a dispute, You agree to attempt to resolve the dispute by contacting Us at servicesbeacon@gmail.com prior to taking any other action. Failure to contact Us to attempt a dispute resolution prior to taking any other action will result in a breach of this Agreement by You. Any resolution to Your dispute will be considered by Us in good faith and You agree to abide by Our decision. Should You seek a remedy in a court of law, it will be Your responsibility to pay Our legal fees. In addition, You hereby waive any right to a trial by jury in the event of any controversy or claim relating to this Agreement. This Agreement and Your use of Our web site are governed by the laws of the State of Delaware, and the New Castle County Court of Chancery of the State of Delaware will have exclusive jurisdiction over any and all disputes arising out of, relating to, or concerning this Agreement or any other controversy between You and Us. In addition to the foregoing, in the event of any breach or violation of this Agreement, We shall be entitled to enforce all of Our legal remedies for the breach or wrongful activity including, but not limited to, seeking actual damages, the maximum amount of statutory damages under applicable statutes and Acts, profits, treble damages, and attorneys' fees and costs. These remedies and damages are in addition to the monetary payments described above and/or any amounts otherwise due under this Agreement. You understand and agree that Retailer Web Services, LLC and Evolution Vertical LLC, merely maintains the web site for Us and is not a party to this contract.
License and Site Use
We grant You a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with Our express written consent and the express written consent of Retailer Web Services, LLC. This license does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without Our express written consent of and the written consent of Retailer Web Services, LLC. Severability
If any provision, or portion thereof, of this Agreement is held by a court of competent jurisdiction to be invalid under any applicable statute or rule of law, the parties agree that such invalidity shall not affect the validity of the remaining portions of the Agreement and further agree to substitute for the invalid provision a valid provision which most closely approximates the intent and economic effect of the invalid provisions.
Headings
The headings of this Agreement are for convenience only and shall not be used to construe the meaning of this Agreement.
Agreement Updates
This Agreement is effective as of September, 23, 2015. We reserve the right to revise this policy from time to time without prior notice. You will be notified of any material changes in Our Terms of Service either by email or by a conspicuous posting on Our Web site.
